TERMS OF SERVICE

Deliverables
Your photos will be delivered in an online gallery, available for download as high-resolution JPEG files. Your online proofing gallery will be ready within 10 business days, and remain open for 30 days.

Fees
The Package prices and deliverables are in accordance with my standard price list. Packages include a set shoot length, an online proofing gallery, digital processing of the camera RAW files and all density and colour corrected high-resolution images in JPEG format. They include printing rights for the images for up to 1000 prints for personal, promotional and editorial use. Additional hours of photography are available for $120 per hour, billed in half hour increments, which is due prior to the end of our session by either personal check, e-transfer or cash.

Travel is included for locations within 20 km of Cumberland, BC. Locations outside of the 20 km radius will be subject to a travel rate of $0.80 per km, plus any applicable transportation fees such as ferry tickets and flights.

Deposit and Payment
Upon payment, I will reserve your time and date, and will not make other reservations for that window. A 50% non refundable deposit is required to secure your spot.

Full payment and any additional travel fees must be paid by the end of our session. A 5% late fee will apply each week after this deadline passes. No services will be made until a deposit has been recieved. No photos will be released until full payment is made. Please make any cheques payable to Ocea Hill.

Rescheduling/Late Arrivals
You are welcome to reschedule your session up to 48 hours before your start time. Your deposit will be applied to your new date. I will not be able to guarantee my availability in the weeks proceeding our session. Rescheduled sessions must be made within the same calendar year.

Cancellation
If you cancel our session or fail to show at least 48 hours notice when rescheduling a session your deposit will be forfeited.

Artistic Rights
I have sole discretion in selecting the photographic materials released. Unless agreed upon prior to any editing work, high resolution digital files, discs and/or proof sets may include a mixture of colour, black and white, and selective colour images. An alternately coloured version of an image may be purchased at the current rate of $25 per image.

Delivered prints may not include all images shot. I reserve the creative right to edit and release only those images deemed credible as professional in quality and within my artistic standards.

Photographic Materials
I will make your gallery proofs available through Pic-time, an online gallery proofing website. These proofs shall be available to the Client within 10 business days of the session. When the online proofing gallery is delivered, it shall remain open for 30 days from the delivery date.

I ask that any requests for additional photographs or changes to your images are be made within 10 days following delivery of the online gallery. If you need to extend the time or reopen the gallery a reopening fee of $50 will apply. Be advised that RAW files may be destroyed at any time after the online gallery has closed.

Copyright and Reproductions
I will own the copyright of all images created and retain the right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website and/or studio. If I wish to make other uses, I will not do so without obtaining your permission in writing. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright Law Title 17, Appendix V. Additional Provisions of the Digital Millennium Copyright Act 2005, Section 102} without my written permission.

Clients Usage
Your package includes the rights to use the prints, including digital files, for personal, promotional and editorial purposes. Your prints include the right for either promotional or personal use. When published, it is required that appropriate citation be made, [Photographer: Ocea Hill ].

I obtain all copyright for the images, therefore failure to use proper citation or tagging will be considered a copyright violation. You copy, download, screenshot, or capture the photographs in any other fashion other than through the links I’ve delivered. This ensures that the images shared are downloaded directly from the digital image files and are not screen-shot and reduced “altered” to a lower resolution.

You agrees that under no circumstances you will alter the images. As a photographer, the photographs that are placed online need to be accurate representations of my work so that future clients have a good understanding of the type of photographs they will receive.

Social Media Use
I as that you tag @ocea.hill in the image itself in any posts or stories. You are welcome to also credit me in the caption, but it is not required. You agree to be responsible for any third-party, family member, or friend who posts the photographs online and agrees that they cannot be cropped, altered in colour, or edited/filtered in any way. Appropriate citation also includes tags and linking on social media handles.

Capturing Desired Photographs
You are welcome to develop a list of desired poses, locations and subjects (models; props; clothing etc.) and share this with me in the weeks before our session. I recommend doing this at least a week before your session. I will NOT be held accountable for not capturing desired photographs if there is no one to assist in identifying or gathering people/items/locations for the photograph(s). I will be held not for missed images or due to details not revealed to me, or for an individuals’ failure to be present.

Failure to Perform
If I am unable to perform my duties due to illness, emergency, fire, casualty, strike, unsafe environment, threat, act of God or causes beyond my control I will not be held liable for missing our scheduled session. I will offer a replacement photographer of similar caliber or return any fees paid and have no further liability. If the I am unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited. The limit of liability shall not exceed the price of the service. I will not be held responsible for any ruined photographs due to any cause outside of my control.

Photographer’s Standard Price List
All charges are based on the my Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

Limitation of Complaint
You have thirty days after your gallery has been delivered to bring awareness to any issue, discrepancy, technical problem or any other complaint regarding photos, their quality and contents. Re-edits after this term may be made if deemed appropriate by Ocea Hill but will incur a retouching fee of $22 per image.

Indemnification
I shall be held harmless for any and all injury to Client during the course of the photography session and the immediately surrounding events.
